ABSTRACT Education appears to bear responsibility on the one hand to do justice to society’s need for reproduction and continuation, and on the other to do justice to the individual’s capacity for and need to express resistance, critique and political action. How we navigate this problem is tied to how we understand justice. ‘Plastic justice’ is the suggestion that questions concerning justice and education might find a materialist expression instead of the usual transcendental ideals of justice. In this perspective, ‘justice’ (...) appears not as an achievable ideal but as a philosophical void that allows us to identify and react to injustice. An example of this is the void that allows for social selection – in the form of admissions or exams – that must be kept open if we wish to avoid encouraging social conformism and reproduction. In this paper, I address the interdisciplinary character of development studies and ethics by discussing the relationship between Christian theology and development studies in general and development ethics in particular. I begin by presenting development theology, a kind of theology that critically reflects on the meaning and implications of the Christian faith with regard to improving the lives of people living in material poverty. This kind of theology is related to the better-known liberation theology, and I discuss the role of (...) this kind of theology in the works of Denis Goulet, the founder of development ethics as an academic discipline. I argue there is a fruitful, critical and constructive relationship between liberation theology and development ethics in the writings of Goulet. I then turn to how development issues are addressed in contemporary theology, with an emphasis on documents produced by two faith-based development organizations, Christian Aid UK and Norwegian Church Aid. I argue that development issues have been readdressed in Christian theology, relying less on the notion of liberation, but more on the concepts of reconstruction, ?diakonia?, human dignity and human relationships. I argue that there is a need to revisit the critical and constructive connections between Christian theology and development ethics and, more broadly, the related challenges of interdisciplinary inquiries, and I conclude by showing some of the ways of undertaking this task. Many influential litterati were convinced of the poems’ antiquity, among them Goethe, Herder, Cesarotti, and a host of Scottish intellectuals. 7 But there were also detractors, mainly English—for example, Dr. Johnson and Edward Gibbon—although David Hume soon joined the skeptics, and the Scotsman Malcolm Laing issued the most crushing attack in the exchange several decades after Ossian’s first appearance in 1760. 8 The Ossian poems served a potent mixture of scholarly and political concerns, of which some were new but some were venerable. With a subtle but important shift in balance, the same mixture underlay the willingness of the most prominent eighteenth-century critics to discredit problematic texts and textual myths, even at the cost of an apparent reduction in historical knowledge. 9 For all parties Macpherson’s Ossian invited not only aesthetic delectation, but sustained thought about the relationship between early poetry and history and the value of early texts for reconstructing the past. [End Page 310]The question of British origins had preoccupied seventeenth-century antiquaries for a number of reasons, including Polydore Vergil’s unflattering Anglica Historia (first published 1546). 10 In the campaign to establish respectable national roots the Celtic druids had quickly become a kind of favorite example; they were presented early and often as heroes of British culture. The druids and their associates the bards had been described in their French setting by classical authors; William Camden, John Selden, and others transferred them easily to Celtic Britain. It was then straightforward to suggest further that the British Celts were the first discoverers of writing and philosophy, or at least discoverers concurrent with the ancient Hebrews, or both, this theory having been elaborated for the French Celts through Annius of Viterbo’s historical forgeries of 1498 and Annius’s French partisans. 11In fact this theory placed England at a disadvantage as Scotland, Ireland, and Wales had the more convincing joint claim to Celtic ancestry. Individual claims for Scotland and Ireland were frequently heard as well. The text most relevant to Ossian was the deist John Toland’s 1726 history of the druids, in which Toland both satirized the eighteenth-century clergy and argued that the ancient Celts of France and Scotland were colonists from Ireland—the original home of druidism, learning, and Toland. 12 In Toland’s version the theory made much of certain unpublished Irish manuscripts, supposedly dating from Cicero’s day and written in the “native” Irish alphabet. Bildung has lost its critical potential, some thinkers worry, but I put forward that this might not necessarily be the case. Jan Masschelein and Norbert Ricken argue that modernity has seen Bildung and bio-power grow complicit, effectively negating Bildung’s critical edge by turning criticism into a necessary aspect of contemporary society. However, a development of this sort seems to demand a view of both Bildung and bio-power as sovereign entities that subvert the individuals who constitute them. I challenge this view (...) by reference to Catherine Malabou's philosophy. Malabou argues that bio-power seems to suffer from a residual sovereign element which upholds a separation between a material and a symbolic mode of life, even if bio-power was originally thought as a break with sovereign thinking altogether. Malabou’s engagement with the biological concept epigenesis by way of her own concept plasticity provides an ostensibly non-sovereign approach to bio-power, one that emphasizes change, creativity, accident, and reciprocal influence. I suggest that this point of view might challenge the apparent sovereignty of bio-power and open up for a non-sovereign formulation of Bildung. (shrink)

This article investigates the communication of professional ethos, the ethical standards of a profession in training, from passing on ideas of patients’ welfare in medical schools to communicating values in military academies. The article examines this through a consideration of the consequences of Wittgenstein’s discussions on the nature of language: how words and sentences acquire meaning. Wittgenstein’s rule-following paradox, the paradox that any act can be brought into correspondence with a rule and thereby that any “meaning” might be applicable to (...) what is being taught, must make us re-evaluate assumptions about a professional ethos as a guide for professionals in their future practice. If, as Wittgenstein asserts, the meaning of a word is its use, we must abandon ideas of an essence of professional ethos encapsulated in words. Ethical standards of the professions are not reducible to a set of rules. Instead teachers must seek to expand the learner’s repertoire of responses and invite different answers rather than a pre-established correct answer. (shrink)

We have arrived at a situation in which policymakers and ethicists are considering abandoning informed consent in the governance of certain new technologies, many of which are related to large-scale information systems. A paradigm case is the problem with using individuals’ informed consent to regulate biobanks. As sometimes suggested, there is a need for “new ethical frameworks.”.

This article is an analytic register of recent European efforts in the making of ‘autonomous’ robots to address what is imagined as Europe’s societal challenges. The paper describes how an emerging techno-epistemic network stretches across industry, science, policy and law to legitimize and enact a robotics innovation agenda. Roadmap is the main metaphor and organizing tool in working across the disciplines and sectors, and in aligning these heterogeneous actors with a machine-centric vision along a path to make way for ‘new (...) kinds’ of robots. We describe what happens as this industry-dominated project docks in a public–private partnership with pan-European institutions and a legislative initiative on robolaw. Emphasizing the co-production of robotics and European innovation politics, we observe how well-known uncertainties and scholarly debates about machine capabilities and human–machine configurations, are unexpectedly played out in legal scholarship and institutions as a controversy and a significant problem for human-centered legal frameworks. European robotics are indeed driving an increase in speculative ethics and a new-found weight of possible futures in legislative practice. (shrink)

This article tries to defend such a definition under contemporary conditions, taking into account what we now know of the construction and inhabitation of human identity. Summing up seminal insights into the development of identity from the social sciences and from gender studies, the article discusses possible consequences for the theological understanding of homosexual cohabitation. A range of insights are brought into play, including the phenomenology of Knud Ejler Løgstrup, to understand the emergence of identity through human interaction, and its implications for the centre of evangelical belief and ethics. Patients in nursing homes sometimes give accounts of episodes in which they feel their autonomy and/or self-respect are violated as a result of the care they receive from nursing staff. In these ethically difficult care situations nurses use strategies such as negotiation, explanation and, in some cases, restraint. This study investigates how nurses apply these strategies to resolve ethical dilemmas in such a way that patients experience respect rather than violation. Critical issues that will be discussed include the definition of (...) ethically difficult care situations in nursing homes and the identification of strategies for resolving such situations. Examples of the use of three strategies are presented. The use of negotiation, restraint and explanation are discussed in order to ensure respect for patients’ autonomy and thus to optimize health care outcomes. (shrink)

The article aims to show that the theory of open and autopoietic systems may be applied in such a way as to transcend the sterile opposition between autonomy aesthetics and culturalism. A theory of contemporary and modern art as an observational system is outlined. Art is seen as specializing to an increasing degree in cannibalizing the discourses and modalities of media & communication industries. Art is thus a parasitical observer (Serres 1980). Why should one affect a shift in framework? What (...) are post-Luhmannian optics on contemporary arts and media able to do beyond what post-structuralist and postmodern optics already achieve? Post-structuralist aesthetics deal with contingency, insecurity, paradox and autoreflexivity, surplus meanings, and the complexity and decentering of the subject. Switching to systems theory allows us to treat such issues without building a wall of irrationality around the arts and the humanities. It handles these important issues in a systematic manner which links up with scientific discourse and with the advanced problem solving and criticality of other social domains, like politics, business and the media industries. Notably the rigueur and self-reflectivity of the conceptual framework allows us also to define limits of our approach. What is it about art which aesthetics cannot and should not explain? (shrink)

This book engages with post-truth as a problem of societal order and for scholarly analysis. It claims that post-truth discourse is more deeply entangled with main Western imaginations of knowledge societies than commonly recognised. Scholarly responses to post-truth have not fully addressed these entanglements, treating them either as something to be morally condemned or as accusations against which scholars have to defend themselves (for having somehow contributed to it). Aiming for wider problematisations, the authors of this book use post-truth to (...) open scholarly and societal assumptions to critical scrutiny. Contributions are both conceptual and empirical, dealing with topics such as: the role of truth in public; deep penetrations of ICTs into main societal institutions; the politics of time in neoliberalism; shifting boundaries between fact - value, politics - science, nature - culture; and the importance of critique for public truth-telling. Case studies range from the politics of nuclear power and election meddling in the UK, over smart technologies and techno-regulation in Europe, to renewables in Australia. The book ends where the Corona story begins: as intensifications of Modernity's complex dynamics, requiring new starting points for critique. (shrink)

Philosophical anthropologies that emphasise the role of the emotions can be used to expand existing notions of moral agency and learning in situations of great moral complexity. In this article we tell the story of one patient facing the tough decision of whether to be tested for Huntington’s disease or not. We then interpret her story from two different but compatible philosophical entry points: Aristotle’s conception of Greek tragedy and Karl Jaspers’ notion of Grenzsituationen (boundary situations). We continue by indicating (...) some ways in which these two positions may be used for reflecting upon different perspectives involved in clinical decision-making, those of patients, clinicians and bioethicists. We conclude that the ideas we introduce can be used as hermeneutic tools for situating learning and dialogue within a broader cultural field in which literature and art may also play important roles. In this article I consider some central aspects of the naturalist philosophy of science and science and technology studies in dealing with the contested status of technoscience in medicine. Focusing on the concepts of realism and representation, I argue that theories of science-as-practice in naturalist philosophy of science should expand their scope so as to reflect more thoroughly on the social and political context of technoscience. I develop a hermeneutic of technomedical objects in order to highlight the internal connectedness between (...) social action, material agency, and the actions of scientific communities. The framework thus developed is used to re-consider the genomic turn in medicine. Pointing to the discrepancies between socially dominant representations of genomic technology and the actual interventions brought about through those technologies, I raise the question of how and where to address problems of theory and policy. High technology and nursing: ethical dilemmas nurses and physicians face on high‐technology units in Norway Results from two studies of ethical dilemmas nurses and doctors experience on two high‐technology units are compared and discussed. The qualitative comparative methodology of grounded theory was used to generate theoretical frameworks grounded in the empirical realities of the units. The ethical dilemmas they faced were related to: treating the one vs. the common good; end of life questions; and resource allocations with inadequate staffing. Similarities (...) were related to intensity and urgency of nursing care and patient treatment, clear nursing ideologies based on treating humans within a framework of hope, embracing technology and scarce resources. Differences between the two study units were patient diagnosis, hierarchical structure on one unit while one had a vertical structure and decision‐making processes, and finally how nursing knowledge and autonomy were used. The two studies demonstrated that clinical, ethical and administrative interactions and decisions are highly compounded, stressful and intertwined. (shrink)

Studying women farmers who are equal to men in their formal status, this article explores the extent to which women's entry into a male occupation challenges the existing gender system. Our analysis shows that young women farmers represent a change toward a new work role for women in farming. They have become similar to men farmers in many important aspects of farming such as vocational training, technological know-how, and union membership; however, important aspects of the existing gender system are being (...) preserved. Young women farmers still have the main responsibility for domestic work; their income from farming is less important for the household than their husband's; and, compared to men farmers, their farm income is less. There is no indication that young women farmers challenge the masculinist way of farming. (shrink)

Parfit's reductionist theory of personal identity states that a person's persistence through time is just a matter of psychological continuity and connectedness. He uses this theory to argue against the requirement of equal concern: the view that a rational person should be equally concerned about all parts of her future. The argument is that since psychological connectedness is one of grounds of a person's concern for her future and since connectedness is weaker over longer periods, it follows that a person (...) can rationally care less about her more distant future. I argue that Parfit's argument fails because the principles it employs generate counterexamples. I conclude by showing that if Parfit's view is modified so as to avoid these counterexamples, his argument against the requirement dissolves. (shrink)

he article combines Elinor Ostrom’s design principles for common-pool resources and human rights provisions, including subsequent clarifications and jurisprudence. It analyses whether stronger local self-governance, embedded in the natural resource dimension of peoples’ rights to self-determination is a recommendable approach. Two changes in understanding are noted. First, the universal approval of indigenous peoples’ right to self-determination as specified in the UN Declaration on the Rights of Indigenous Peoples. Second, the wide endorsement of the specific principle of free and prior informed (...) consent. As the exercise of peoples’ rights to self-determination is done on a collective level, it is important to have awareness of whether particularly affected and marginalized households and individuals are included or not included in the decision-making process. The article then reviews a range of new instruments adopted by the OECD and the UN for improved human rights awareness and compliance in the context of economic investments. The article finds that these instruments are still underutilized. Finally, the article identifies the role of human rights in bilateral investment treaties. It finds that there are less jurisdictional restrictions – as many treaties have a wide understanding of applicable law – than cognitive restrictions – as human rights competence is rarely sought when establishing tribunals mandated to solve investments disputes. A number of years ago we argued that Hartshorne’s psychicalism and his doctrine of divine memory are incompatible with contemporary big bang cosmology. Theodore Walker has responded to our objection by arguing that our understanding of psychicalism is flawed and that Hartshorne’s metaphysics has the resources for accommodating what the big bang theory says about the origin and fate of the universe. In the present article we attempt to show that Walker’s defense of Hartshorne fails.

No global professional codes for the natural science and technology professions exist. In light of how the application of new technology can affect individuals and communities, this discrepancy warrants greater scrutiny. This article analyzes the most relevant processes and seeks to explain why these processes have not resulted in global codes. Moreover, based on a human rights approach, the article gives recommendations on the future process and content of codes for science and technology professions. The relevance of human rights in (...) the realm of individual conduct is based on the fact that while human rights treaties primarily outline State obligations, individuals have responsibility for human rights promotion. Human rights principles have only recently been subject to interests from policy makers and academics, and must be better clarified. Den andre retningen argumenterer for at interessene og rettighetene for de mest sårbare må ha forrang i politiske prioriteringer, og at de sårbare sikres best med en strategi basert på menneskerettigheter. Artikkelen drøfter landfordeling, økt bruk av genteknologi i landbruket og nedbygging av handelshindre for landbruksprodukter. Industrialisering av landbruket og liberalisering av handelen med landbruksvarer kan gi gode resultater på makronivå – på kort sikt. All agree that the overall production of food in the world is adequate for everyone's nutritional needs. The article demonstrates that there are two main approaches in the debate on food production. The dominant approach focuses primarily on food security, understood as increased food production and increased food trade. The other approach argues that the interests and rights of the most vulnerable must prevail, and that improvements for the vulnerable are best ensured with a strategy based on human rights. The article analyzes land distribution, increased use of genetic technology in agriculture and reduction of trade barriers for agricultural products. Industrialization of agriculture and the liberalization of trade in agricultural products can provide good results at the macro level – in the short term. If the goal is to promote the situation of the most vulnerable and at the same time addressing climate change, the solution is a bottom-up approach, which until now has been ignored by most states. Tax havens and tax secrecy have risen to the top of the global policy agenda and may constitute the most important impediment for reducing inequalities. Moreover, complex corporate structures allow charging for services undertaken in various countries through one low-tax country. Transferring profits to low-tax jurisdictions will significantly reduce a multinational corporation’s overall tax burden. Individuals are assisted in opening shell corporations that officially own bank accounts where the real owner is not revealed. Reducing this practice of tax dodging has (...) proven to be difficult, despite substantial efforts by several international organizations and states over the last decade. It is too easy to be removed from the list of tax havens; mere membership in OECD’s Global Forum on Transparency and Exchange of Information for Tax Purposes qualifies. Tax dodgers add to global inequalities and severely weaken states’ capacity to undertake their task of creating a solid tax base, embedded in the principle that all actors are taxed according to the income generated in each country.
